Dedyansyah Laode Ilo, Legal Liability of Environmental Pollutions Involving Government and Corporation. This study aims to analyze two things, firstly, how to determine legal liability if the defendants involve the government and the company; second, What is the responsibility of the government and the company in the civil section if the civil rights fulfillment is demanded by the plaintiff.
This research uses socio-legal research approach. Source of data obtained in the form of primary and secondary data source. The location of this research was conducted in Santan Village, Marangkayu District, Kutai Kartanegara Regency.
The results of this study indicate that, although the rules, theories and facts are found, the determination of liability if the defendants involve the government and mining companies is based on the categorization of the subject of civil liability onrechtmatigedaad (for corporate / corporation) and onrechtmatige overheidsdaad (for the government). Pollution of the environment is a river, causing harm to people whose territory is not far away from coal mining activities. This is related to the granting of civil liability that must be done by the government and the company in the form of compensation or restoration of the environment.
